Consumer Rights Under the FCRA

This government notice regarding the applicant’s rights under the FCRA (The Fair Credit Reporting Act) must be provided to any candidate who is given any pre-adverse or adverse action letter.

Final Notice of Adverse Action

If the results of an employment background report prompts a decision to turn down an applicant or dismiss an employee, federal law requires the employer give that information to the candidate in an adverse action notice. Along with the letter you must provide a copy of the Consumer Rights Under the FCRA and a copy of the report you based your decision on and the company you used to obtain the screening report.

Pre-Adverse Action Letter

The letter is used to notify an employment candidate that information contained in their background report may negatively affect a decision about their employment. It is intended to give the candidate an opportunity to respond to the information contained in the report. Along with the letter the employer must provide a copy of the Consumer Rights Under the FCRA and a copy of the report you based your decision on and the company you used to obtain the screening report.
